1. Agreement

These Terms form an agreement between you and LemiGuide regarding Learn Spanish. By installing, accessing, creating an account, or purchasing a subscription, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and accounts

You must be legally able to accept these Terms. If you are under the age of legal majority, a parent or guardian must approve your use and any purchase. Provide accurate account information, protect your credentials, and notify us of suspected unauthorized access. You are responsible for activity performed through your account.

3. The service

Learn Spanish provides Spanish lessons, tests, progress tracking, text-to-speech and pronunciation tools, and AI conversation practice. Features, lesson counts, limits, and availability may change as we improve the service. Some functionality requires internet access, microphone permission, a supported speech service, an account, or an active subscription.

4. AI tutor

The AI tutor uses automated systems supplied by OpenAI. Its speech, transcripts, translations, corrections, and explanations may be incomplete or wrong. Verify important information independently. Do not submit confidential, unlawful, or sensitive personal information. The tutor is not a human teacher and does not provide medical, legal, financial, safety-critical, or professional advice.

5. Free access and Premium

The first course sections and limited AI practice may be available without charge. Premium unlocks later course sections and additional practice features. AI speaking practice is currently limited to 60 minutes per subscription month and no more than 10 minutes per day. Exact benefits and limits shown in the app at purchase time form part of your offer.

6. Subscriptions, introductory pricing, and renewal

• Subscriptions are sold and billed through Google Play using the plan and localized price displayed before confirmation.
• An introductory offer may charge a reduced amount for the displayed initial period. When that period ends, the subscription automatically renews at the clearly displayed recurring price and frequency unless canceled beforehand.
• Weekly, monthly, and annual options may be available. Prices, taxes, currencies, eligibility, and offers may vary by country and Google Play account.
• Google Play controls payment authorization, renewal, cancellation, grace periods, refunds, and payment-method handling. We do not store your full card details.
• Manage or cancel through Google Play → Profile → Payments & subscriptions → Subscriptions. Deleting the app or your Learn Spanish account does not by itself cancel the Google Play subscription.
• Refunds are handled under Google Play policies and mandatory consumer law. Restoring purchases requires the same Google Play account used to subscribe.

7. Acceptable use

You may not abuse, disrupt, scrape, reverse engineer, resell, sublicense, bypass limits or payment controls, automate excessive requests, probe security, submit unlawful content, infringe rights, impersonate others, share API credentials, or use the service to develop a competing AI model. We may restrict access to protect users, providers, and infrastructure.

8. Intellectual property

Learn Spanish, its design, course structure, lessons, software, branding, and original content are owned by or licensed to LemiGuide and protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for personal language learning. Spanish words and ordinary facts are not claimed as exclusive property.

9. Feedback

If you send suggestions or feedback, you allow us to use them without payment or restriction, while we continue to protect any personal information under the Privacy Policy.

10. Third-party services

The service depends on Google Play, Firebase, OpenAI, Android system services, and hosting providers. Their separate terms may apply. We are not responsible for outages or changes outside our reasonable control.

11. Availability and changes

We aim to provide a reliable service but do not promise uninterrupted availability. We may modify, suspend, or discontinue features, introduce reasonable limits, correct content, and update compatibility. If a paid service is materially discontinued, applicable consumer rights remain unaffected.

12. Suspension and termination

You may stop using Learn Spanish and request account deletion at any time. We may suspend or terminate access for material or repeated violations, fraud, security risks, non-payment, legal requirements, or conduct that harms the service. Provisions intended to survive termination remain effective.

13. Disclaimers

To the fullest extent permitted by law, Learn Spanish is provided “as is” and “as available.” We do not warrant that every translation, pronunciation assessment, AI response, lesson, or progress estimate is accurate, that use will produce fluency, or that all devices and speech engines will work identically. Nothing in these Terms excludes warranties that cannot legally be excluded.

14. Limitation of liability

To the fullest extent permitted by law, LemiGuide is not liable for indirect, incidental, special, consequential, or punitive loss, lost profits, lost data, or reliance on AI output. Our aggregate liability relating to paid service will not exceed the amount you paid for Learn Spanish during the 12 months before the claim. These limits do not apply where prohibited, including liability for fraud, willful misconduct, or rights that cannot be waived.

15. Governing law

These Terms are governed by the laws of Ukraine, without limiting mandatory consumer protections available in your country. Courts with lawful jurisdiction may hear disputes. Please contact us first so we can try to resolve concerns informally.

16. Changes to these Terms

We may revise these Terms for legal, security, provider, or product changes. We will publish the updated date and give appropriate notice of material changes. Continued use after the effective date constitutes acceptance where permitted by law.
